Are you charged with possessing drug paraphernalia?

Drug paraphernalia might be a roach clip, rolling papers, a grinder or a pipe.

I do not believe I have ever seen anyone just charged with possessing drug paraphernalia, unless they also have drugs, but in theory it can be done. One exception to that, is when you have a “crack pipe” and you have the residue of crack on the pipe, that is a small amount of powder of the substance.

Generally, the crime of “drug paraphernalia” is a Class C Misdemeanor and is not punishable by jail time, unless you have a prior conviction.

However, many people who receive a ticket for a Class C Misdemeanor such as drug paraphernalia just checkmark guilty or no contest on in the ticket and pay the fine with the ticket.

Generally, this is not a good idea, as you will then have an arrest and a conviction on one, or more, of the databases who keep your criminal record.

Therefore, it is better to hire a lawyer. However, if you cannot afford an attorney and are just charged with drug paraphernalia you are not entitled to a court-appointed or free lawyer.
